Fishery violators get away without paying fines

Fishery officers can catch and fine violators, but significant numbers of offenders don't pay and DFO has made no serious effort to force them to cough up the cash.

A huge number of fines issued for illegal fishing have gone unpaid, raising serious questions about the federal fisheries department's ability to deter poaching.


More than $1 million in fines are currently unpaid in B.C., officials from the Department of Fisheries and Oceans (DFO) disclosed in recent testimony before the Cohen Commission into the decline of Fraser River sockeye salmon.


Since most fines are less than $5,000, the total unpaid reflects hundreds and perhaps thousands of individuals who have refused to pay, confirmed Randy Nelson, DFO's assistant director of conservation and protection.


Nor is there any mechanism with any teeth to enforce payment.


"We don't have a system to collect and follow up," Nelson said under questioning before the inquiry April 8. "It is of concern to officers."


Paul Steele, DFO's national director-general for conservation and protection, told the inquiry the problem gets discussed "from time to time" but the department has been reluctant to spend the money required to pursue unpaid fines.


He also said DFO has trouble getting other government agencies to collect fines on its behalf and fishery officers may also lack the legal powers to execute warrants themselves to enforce payment.


Steele admitted under questioning from lawyer Don Rosenbloom the situation threatens to undermine DFO enforcement efforts.


"If it's widely known that a person could potentially get off without paying a fine, then that could have an effect on compliance and the deterrence level, yes," he said.


The more than $1 million in unpaid fines is a cumulative total that's built up over the years and includes all outstanding fines for Fisheries Act violations – illegal fishing by sports anglers, First Nations and commercial fishermen as well as habitat violations.


Rosenbloom said later he was "shocked" by DFO's admission of outstanding fines and its failure so far to act.


Craig Orr, executive director of the Watershed Watch Salmon Society, also said he was disappointed by the high number.


"The environment and the fish are the losers when we don't collect those fines," Orr said, noting the money can often be channelled into stewardship projects or habitat restoration.


"They need to improve that system," said Sto:lo fishery adviser Ernie Crey, another regular observer at the sockeye inquiry, who pointed to impending budget cuts at the department.


"They're about to lose $57 million over the next two years. And they need to find ways of collecting this money if they hope to enjoy credibility on the fishing grounds. So you have a double incentive to go collect these fines."


Dennis Brown, author of the book Salmon Wars and a researcher watching the commission, said illegal fishing at upriver sites has been repeatedly flagged as a concern by past inquiries and DFO's disclosure will anger commercial fishermen.


"We see less and less enforcement in the budget," Brown said. "If they are that badly off they can't even collect fines for the convictions they've got, our resource is dreadfully in peril."

The fact that this information is publicly available will encourage future violators to 'dodge' their fines.  Unacceptable.  It has been proven time and again that we require a more effective system in dealing with those who ride south of the law - yet another example here.

Harper might be going the route of giving the fishing quota to one or two commercial interests and letting them self regulate it. :-\ Then those groups can be blamed for any disastors. While letting them reap short term gain. Anyone can get to the front of the list with a decent contribution to the Conservitive party. There the one's making the cut's.

Probably one of many on the payroll who don't like facts getting out. Where is the "director of conservation and protection". Probably feels too important to show up to any meeting that isn't poshly catered.

--follow up and collection of fines not just a DFO issue, I believe you will find provincial Forestry and other agencies have similar issues.
--also think fines go to general revenue and are not assigned to the department... the department can make a plea to treasury dept for funding to recover costs of issuing fines etc. but they would not get the money directly.
--not that someone who fishes illegally would care but I don't think it would be to difficult.. especially now with electronic license to not issue a license if a fine is outstanding... used to work with insurance..
--there is no easy solution to this and as we have seen in other discussions many people here think you should try to duck paying a fine even if you are guilty.

--I'm not much if favour of fines as the only deterrent... I would rather see more people on the ground doing prevention work... Officer sees person not following the rules they stop them.
--My own experiences with forestry prior to it moving to more enforcement rather than compliance is that in many cases I feel the administrative penalty system was much better... we saw something... like a culvert plugged... If I could I would just remove debres and call the company so they could follow up or if more work was required I'd call the company and they would send some out immediately if necessary to fix the problem. Fines don't fix or prevent  the problem.

No wonder the sport fishing licenses cost so much in BC.  If they were to contract Family Maintenance Enforcement to collect these fines it would be solved by the end of the month.  Those gargoyles can squeeze blood from a stone and if that fails they destroy the lives of those that don't pay up.  I agree, this is ridiculous, no wonder they commonly seize gear; writing a ticket is no punishment if they cannot enforce it.

I was told that if you do not pay your fines then a warrant would be issued for you similar to what they do in the states? I guess this is untrue then?

true story, my buddy got arrested when we were at a club, he doesnt fish much and was out with an expired licence and got tagged, needless to say when the gang task force came in for a few guys they wanted and were running everyone elses drivers licence for warrants they found out about the unpaid fine and warrant and his my friend went to jail for a night haha

ya in alberta you can do time for unpaid traffic tickets as well.
