What would you do? Need help.

I brought my baby in to get her 12 km service yesterday, ( 07 Dodge 3500) oil change, rotation and some checks. I get a call saying that they have damaged my driver side door and that they are going to fix it right away.
I told them to not do anything until I get there. When I get there I was horrified both the A and B pillars were totally crushed so bad that they kinked the front quarter panel.
Now the quarter panel and the door have to be completely replaced and painted. We all know how they can never quite get it back to the factory finish. Also now the truck has to be declared over 2000.00 dollars in damage if I sell it. Should I get a lawyer, restitution, a new truck? I can't think straight please help. :'(

Hey Lumps,

Sorry to hear about your truck. This advice comes from a person (me) who deals with ICBC almost on a daily basis through their profession.

1) Tell them not to touch your truck.
2) Have them tow it to an ICBC Claim Centre.
3) Have ICBC assess your truck, and see if it will be roadworthy after the repairs. The fact that 2 major structural pillars in your truck have been damaged badly may mean that the vehicle is considered a "write off".
4) Advise both the garage and ICBC you are SERIOUSLY considering retaining a lawyer if this is not delat with to your satisfaction.

I mentioned this on the other site but considering the state that chrysler is in right now, they don't need any more bad press and I'm sure would respond well to a threat of you going to "olsen on your side" with BCTV.  I'd prepare a letter to BCTV and send a copy of it to the manager at the dealership, letting them know you are considering sending it should they not take appropriate action and replace your now devalued vehicle with a brand new fully loaded one, for your troubles. 

I'm surprised its not a write off......sounds like the dealership is just lowballing...they'll always go as cheap as they can at first, its their game.  They'll crack, just don't give in.

Agree with C-Pin - get ICBC involved and talk to a lawyer.  There is too much money at stake to do anything less.

im curious how did the damage happen ??? or what was there excuse for the damage ???
same thing happened to me with my mini van >:( the hole drivers side from front to back like they
drove by a wall with a peice of re-bar was sticking out the van was a write off they paid me out for 10 thousand as long as i singed on the dotted line
not bad for a 1990

What C-pin said.  I'll bet they dropped your truck off a lift.  It only had 12k km?  You get a new truck, just like that!  Or you really raise hell with them.

I'd also certainly start with ICBC, but if that is not successful, then if it is a new car dealer, take a look at this site. If the dealership you are having the difficulties with is a member, then the association might be able to help you.
